1. Agreement
These Terms of Use (“Terms”) are a legal agreement between you and
Movenue (“Movenue,” “we,” “us,” or “our”) governing your use
of the Movenue mobile and Apple Watch applications, movenue.me, and related
services (together, the “Service”).
By creating an account, accepting these Terms in the app, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.
Additional terms may apply to a particular feature, promotion, app store, or jurisdiction. If additional terms conflict with these Terms, the more specific terms control for that feature to the extent permitted by law.
2. Who may use Movenue
You must:
- be at least 13 years old;
- meet any higher minimum age or parental-authorization requirement where you live;
- have legal capacity to agree to these Terms or use the Service with valid authorization from a parent/guardian where legally permitted;
- not be prohibited from using the Service under applicable law;
- use Movenue only in supported territories.
Movenue is not directed to children under 13.
If you use Movenue for an organization, you represent that you are authorized to bind that organization, and “you” includes it.
3. The Service
Movenue is a general fitness and social workout service. Depending on the current release, it may let you:
- create, import, export, publish, save, schedule, and complete routines;
- use a counter/timer workout coach, recovery, audio cues, and Live Activity;
- use an Apple Watch companion for available fitness readings;
- create a profile and interact with eligible community content;
- participate in eligible scheduled or live workout events;
- review and export eligible workout history;
- manage visibility, sharing, and other preferences;
- report/block and request support;
- delete your account.
Features depend on device compatibility, permissions, operating systems, connectivity, region, production services, and release status. Movenue may add, change, suspend, or discontinue a feature as described in Section 20.
AI routine generation shown in a development/MVP preview is not a released or reliable personalized training service unless we expressly announce otherwise in an approved production release.
4. Fitness and medical limitations
Movenue provides tools for general fitness and wellness. It is not:
- a medical device;
- a health-care provider;
- emergency or remote-patient monitoring;
- medical, nutritional, rehabilitation, or professional training advice;
- a substitute for a qualified physician, clinician, physiotherapist, trainer, or emergency service;
- a system that verifies exercise form, equipment, environment, or whether a routine is safe for you.
Workout content may be created by members, imported, or automatically processed. We do not endorse or verify every routine, target, threshold, image, note, comment, or creator.
Before and during exercise:
- consider your health, ability, experience, environment, equipment, weather, hydration, and appropriate supervision;
- inspect the routine and space;
- use equipment according to its instructions;
- stop if you experience pain, faintness, chest discomfort, unusual shortness of breath, loss of coordination, or another concerning symptom;
- seek qualified professional advice before beginning or changing an exercise program where appropriate for you;
- contact local emergency services in an emergency.
Do not rely on Movenue, an audio cue, threshold, notification, event participant, or device reading to detect danger or decide whether to continue. See the Health and Safety Notice, which is incorporated into these Terms.
Nothing in these Terms excludes duties or liability that cannot lawfully be excluded.
5. Apple Watch, HealthKit, location, and sensor data
With applicable permission and hardware, Movenue’s Watch companion can read heart rate through HealthKit and estimate pace/distance using location during an active iPhone workout. Sensor and derived readings:
- may be delayed, missing, incomplete, or inaccurate;
- depend on device, fit, skin contact, movement, location signal, environment, permissions, connection, battery, and Apple’s services;
- are provided for general fitness information only;
- are not medical measurements or emergency alerts.
NA means an eligible reading is unavailable. A configured metric threshold
is a coaching preference, not a safe/unsafe boundary.
You control applicable Apple system permissions. The Privacy Policy explains data practices.
6. Account and sign-in
You are responsible for:
- providing accurate information;
- maintaining control of the identity-provider account and device used to sign in;
- protecting device passcodes and account access;
- choosing a lawful, appropriate username/profile;
- notifying us promptly of suspected unauthorized access;
- activities under the account unless caused by our failure to use required care.
Do not:
- share or transfer an account;
- impersonate another person or organization;
- create an account for someone without authorization;
- bypass age, suspension, block, rate-limit, or access controls;
- send anyone a password, identity-provider code, Movenue token, or session credential.
Usernames may be unique, restricted, reserved, normalized, and unchangeable in some releases. We may reclaim or restrict a username that infringes rights, impersonates, misleads, violates these Terms, or is required for service operation, with notice where appropriate.
7. License to use the app
Subject to these Terms and applicable app-store terms, Movenue grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one object-code copy of the app on devices you own or control and as otherwise allowed by the applicable platform’s usage rules, solely for lawful personal use of the Service.
You may not:
- copy, sell, rent, lease, sublicense, distribute, or commercially exploit the app or Service except as expressly permitted;
- reverse engineer, decompile, disassemble, or attempt to derive source code except where law gives a non-waivable right;
- remove ownership notices;
- bypass security, access, usage, rate, or privacy controls;
- introduce malware or harmful code;
- scrape, crawl, index, or automate access contrary to published interfaces or written permission;
- probe, scan, disrupt, overload, or test vulnerability without authorization;
- use the Service or its output to build a competing dataset/model/service in violation of law or our rights;
- use Movenue to violate another person’s rights.
No right is granted except expressly stated.
8. Your content
“User Content” includes profiles, routines, names, descriptions, exercise steps, notes, images, posts, comments, reports, and other material you submit, publish, import, or transmit.
You retain ownership of User Content you own. You represent and warrant that:
- you own it or have all necessary rights and permissions;
- its submission and our use under these Terms do not violate law, privacy, publicity, confidentiality, intellectual property, contract, or other rights;
- it follows the Community Guidelines;
- any person shown in media has provided required permission;
- any fitness instruction is not deceptively presented as medical or guaranteed professional advice.
License to Movenue
You grant Movenue a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt for technical formatting, transmit, and display User Content only as reasonably necessary to:
- operate, secure, support, and improve the Service;
- apply your visibility and sharing choices;
- provide public/social features you select;
- create image renditions and device-compatible presentations;
- investigate abuse and enforce these Terms;
- comply with law.
This license lasts while the content/account is available and for a reasonable technical deletion/backup period, subject to lawful retention. Public content copied or shared by another person outside our control may remain with that person.
We do not claim ownership of User Content. We will not use HealthKit-derived data or User Content for third-party advertising without a new, lawful, clearly disclosed arrangement.
Feedback
If you voluntarily provide product ideas or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation, provided we do not identify you publicly without permission. This does not transfer ownership of separately submitted copyrightable User Content.
9. Public and private content
Visibility controls reduce access within Movenue but cannot guarantee that another person will not view, screenshot, copy, or redistribute public or shared content. Do not publish:
- home addresses or precise routine locations;
- passwords, tokens, payment data, government identifiers;
- confidential medical or health information;
- private information about another person;
- content you do not have permission to share.
A private routine is intended for its owner, subject to necessary processing by Movenue and providers. Public profile/routine/post/comment content may be discoverable and interactable.
Live metric sharing, when available, requires a separate explicit choice and is off by default. Joining an event is not consent to share metrics.
10. Community conduct
You must follow the Community Guidelines. In summary, do not use Movenue to:
- harass, bully, threaten, stalk, exploit, or shame;
- promote hatred or discrimination;
- post sexual exploitation or unlawful sexual content;
- encourage violence, self-harm, dangerous misuse, or illegal activity;
- share private/confidential data or non-consensual intimate content;
- impersonate, defraud, spam, manipulate engagement, or evade enforcement;
- infringe copyright, trademark, or other rights;
- give dangerous, deceptive, or unsupported medical/fitness claims;
- coordinate activity that risks another person’s safety.
Use reporting and blocking tools where available. Movenue support is not an emergency service.
11. Moderation and enforcement
We may, consistent with law and our policies:
- review reports and relevant content;
- limit distribution;
- remove content;
- restrict a feature;
- warn, suspend, or terminate an account;
- preserve evidence;
- refer credible threats or unlawful conduct to appropriate authorities;
- act without prior notice in urgent, severe, security, or legal cases.
We may use automated signals to prioritize review, but material enforcement should receive appropriate human review and an appeal path where required or reasonably available.
We are not required to monitor all content and do not endorse it. Moderation
can be incomplete or mistaken. Contact support@movenue.me to appeal an
eligible decision with the notice/ticket reference.
Blocking is designed to remove certain relationships and visibility but cannot control encounters or copies outside Movenue.
12. Routines, imports, exports, and third-party content
Review every routine before use, including:
- exercise and order;
- sets, reps, durations, and recovery;
- equipment and environment;
- coaching notes and images;
- thresholds and monitored metrics.
Import validation checks technical compatibility, not safety, quality, originality, legality, or suitability. Exported JSON, ZIP, or CSV data may be sensitive and, once shared, is governed by the recipient/destination.
Third-party links, content, identity providers, Apple services, or devices are not controlled by us. We are not responsible for them except where applicable law says otherwise.
13. Scheduled and live workouts
Schedules, reminders, events, rosters, status, audio, Live Activities, connections, and notifications can be delayed, changed, missing, or unavailable. Verify important timing independently.
Other participants are responsible for their own conduct and safety. Movenue does not supervise events, verify a participant’s identity or qualification, provide emergency monitoring, or guarantee attendance/performance.
Do not use Movenue to organize an unlawful, unsafe, unauthorized, or commercially regulated event.
14. Privacy
The Privacy Policy explains Movenue’s data processing and is incorporated into these Terms by reference. System permission is not a substitute for reading the Policy. If you do not agree with required processing, do not create/use an account.
15. Intellectual property
The Service, app, software, design, Movenue name/marks, and Movenue-created content are owned by Movenue or its licensors and protected by applicable intellectual-property laws. These Terms do not transfer ownership.
Apple, Apple Watch, App Store, iPhone, HealthKit, and Dynamic Island are trademarks or services of Apple Inc. Movenue is not sponsored, endorsed, or operated by Apple.
Copyright complaints
Send a notice to support@movenue.me with subject Movenue copyright notice
and include:
- identification of the protected work;
- the specific Movenue content/location;
- your contact information;
- a good-faith statement;
- an accuracy/authority statement under the applicable law;
- signature.
16. Pricing, purchases, and subscriptions
No paid Movenue service is currently offered through this pre-release website. Before any price, purchase, subscription, trial, renewal, tax, refund, or cancellation term applies, the relevant App Store and consumer disclosures will be presented before purchase.
17. Updates
Movenue may provide app updates. Some updates may be required for security, legal compliance, backend compatibility, or continued use. You are responsible for maintaining a supported device/OS and installing required updates.
An update can change features or permissions. We will provide legally required notice and seek additional consent/acceptance where required.
18. Availability and beta features
We aim to provide a reliable Service but do not guarantee uninterrupted, error-free, secure, or permanently available operation. Maintenance, outages, networks, identity providers, Apple services, devices, region, law, abuse, and events outside reasonable control can affect it.
Features labeled preview, beta, test, or under development:
- may be incomplete or inaccurate;
- may not save or synchronize;
- may change or end;
- must not be used for safety-critical or medical decisions.
19. Termination and deletion
You may stop using Movenue, sign out, or permanently delete the account through the app or the Account Deletion page.
We may restrict, suspend, or terminate access when reasonably necessary for:
- a material or repeated Terms/Guidelines breach;
- safety, security, fraud, or abuse;
- legal compliance;
- non-payment if paid services are later added;
- discontinuation of the Service.
Where appropriate and lawful, we will provide notice and an opportunity to appeal. Urgent action may occur without advance notice.
Upon termination:
- the license ends;
- access may stop;
- User Content is deleted/retained according to the Privacy Policy, law, safety, disputes, and backup cycles;
- provisions that by nature should survive remain in effect, including ownership, licenses for necessary retained copies, disclaimers, liability, disputes, and enforcement.
20. Service changes
We may change or discontinue a feature or the Service. For a material change that significantly affects paid services, legal rights, or required processing, we will provide notice/remedies required by applicable law.
Nothing in this section removes mandatory consumer rights.
21. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Movenue disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted operation.
We do not warrant:
- fitness results;
- creator/user content;
- sensor or metric accuracy;
- suitability or safety of a routine;
- uninterrupted synchronization, notifications, Live Activities, events, audio, or Watch connection;
- permanent availability of public/saved content;
- that every harmful item will be detected.
Some jurisdictions do not allow certain disclaimers, so they apply only to the extent legally permitted. Mandatory statutory guarantees remain.
22. Limitation of liability
To the maximum extent permitted by law, Movenue and its officers, employees, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, goodwill, data, opportunity, or business, arising from the Service, even if advised of the possibility.
Nothing limits liability for fraud, willful misconduct, death/personal injury caused by negligence, breach of mandatory data-protection obligations, or any liability that law does not allow to be limited. Your local law may give additional rights.
23. Indemnity
To the extent permitted by law, if you use Movenue on behalf of a business or for commercial/public event activity, you will indemnify Movenue against third-party claims, damages, and reasonable costs arising from your User Content, event, violation of these Terms, or infringement of rights, except to the extent caused by Movenue.
24. Governing law and disputes
Please contact support@movenue.me first so we can try to resolve a dispute informally. If it cannot be resolved, applicable mandatory law governs and a claim may be brought in a court that has lawful jurisdiction. These Terms do not impose private arbitration or a class-action waiver.
Nothing deprives a consumer of mandatory protections or courts available under the law of their habitual residence where those rights cannot be waived.
EU/EEA/UK consumers may have the right to contact local consumer or data-protection bodies.
25. General
- Entire agreement. These Terms and incorporated policies are the agreement about the Service, excluding terms that cannot lawfully be superseded.
- Severability. If a provision is unenforceable, it is modified or removed only as necessary; the remainder continues.
- No waiver. Failure to enforce once is not a waiver.
- Assignment. You may not assign these Terms without consent. We may assign them in a lawful corporate transaction with required notice and without reducing mandatory rights.
- No agency. These Terms do not create employment, partnership, joint venture, or agency.
- Electronic communications. You agree to receive required electronic service/legal communications, subject to applicable law.
- Language. English is the controlling language, subject to any mandatory local-language rights.
- Headings. Headings aid reading and do not control interpretation.
26. Apple-specific terms
If you obtain the app through Apple’s App Store:
- these Terms are between you and Movenue, not Apple;
- Movenue, not Apple, is responsible for the app and its content;
- your license is limited to Apple-branded products you own/control and as permitted by Apple’s usage rules, including use through Family Sharing or volume purchasing where applicable;
- Apple has no obligation to provide maintenance or support;
- to the extent a warranty legally applies and the app fails to conform, you may notify Apple for any app purchase-price remedy Apple is required to provide; to the maximum permitted extent, Apple has no other warranty obligation;
- Movenue, not Apple, is responsible for addressing claims relating to the app, including product liability, regulatory, consumer-protection, or intellectual-property claims, subject to these Terms and applicable law;
- you represent that you are not located in a country subject to applicable U.S. embargo and are not on an applicable prohibited/restricted-party list, subject to law;
- you must comply with third-party terms applicable to your use;
- Apple and its subsidiaries are third-party beneficiaries of this section and may enforce these Apple-specific terms.
